“We’re not surprised by the EPA’s denial of our petitions to reconsider their rulemaking under the Clean Air Act. The EPA maintains – although in direct contravention of statutory authority and case law – that it has the authority to regulate in this area under the Clean Air Act. We intend to continue our work on this matter in federal court, and we intend to appeal this decision immediately.”
